Terms of Service

1. Introduction

Welcome to monuc (Money Under Control) (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of Budgeter and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Definitions

• Service means the Budgeter application and related features, including supported bank-account connection functionality.
• User means any individual or entity that accesses or uses the Service.
• Content means information, data, text, graphics, and other materials provided through the Service.
• Bank Data means account and transaction information retrieved from banks or financial institutions through third-party integrations.

3. Account registration and obligations

• Eligibility — you must be at least 18 years old and capable of forming a binding contract.
• Accuracy — you agree to provide true, accurate, and complete information during registration.
• Security — you are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of unauthorized use.

4. Use of the Service

• Permitted use — you may use the Service solely for personal budgeting and financial management purposes.
• Restrictions — you may not reverse engineer, modify, or attempt to access parts of the Service not intended for you.
• Third-party integrations — bank-account connection features require compliance with applicable provider terms.

5. Payment and billing

• Fees — some features may require payment. Subscription plans, pricing, and billing intervals will be displayed in the Service.
• Payment methods — payments may be processed through authorized payment processors.
• Refunds — refund policies, if any, will be detailed in your subscription agreement or payment flow.
• Late payment — failure to pay may result in suspension or termination of access to paid features or the Service.

6. Intellectual property rights

All intellectual property rights in the Service and its content are owned by monuc (Money Under Control) or its licensors. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.

7. User-generated content

You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, royalty-free license to use, display, process, and distribute it as necessary to provide and operate the Service. We may remove content that violates these Terms.

8. Prohibited conduct

You agree not to:

• use the Service for fraudulent or illegal activities;
• interfere with security features;
• transmit spam or unsolicited communications;
• attempt unauthorized access to systems or data; or
• use the Service in violation of applicable law.

9. Financial advice disclaimer and risk acknowledgment

The Service provides budgeting tools and insights, but it does not constitute financial, legal, tax, or investment advice. You are solely responsible for decisions made based on the Service. Past behavior, historical data, or budget projections do not guarantee future results.

10. Third-party bank/API integration terms

• Authorization — you authorize us to connect to supported accounts through third-party APIs when you use account-connection features.
• Provider policies — you must comply with applicable provider terms, privacy policies, and security requirements.
• Liability — we are not liable for errors, delays, omissions, or outages in Bank Data provided by third-party providers.

11. Data accuracy and transaction errors disclaimer

While we strive for accuracy, discrepancies may occur. You should verify transaction details, balances, bills, and important financial information directly with your financial institutions. We disclaim liability for errors, delays, or omissions in data to the maximum extent permitted by law.

12. Termination and suspension

We may suspend or terminate your access for violation of these Terms, suspected abuse, non-payment where applicable, or if required by law. Upon termination, your right to use the Service ends immediately.

13. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, monuc (Money Under Control) will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

15. Indemnification

You agree to indemnify and hold harmless monuc (Money Under Control), its officers, directors, employees, contractors, and agents from claims arising out of your use of the Service or violation of these Terms.

16. Governing law and dispute resolution

These Terms are governed by the laws of Sweden, without regard to conflict of law rules. Any disputes shall be resolved in the courts of competent jurisdiction in Stockholm, Sweden, unless otherwise required by applicable consumer protection law.

17. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date and, where appropriate, notify you. Continued use after changes means you accept the revised Terms.
